• User, you, or your means any individual or entity accessing or using SandSpace.

3. Eligibility

You must be at least 18 years old to create an account, or have the consent of a parent or legal guardian if you are under 18.

By using SandSpace, you confirm that:

• save and manage personal written content;
• generate downloadable PDF versions of their own content;
• generate images using the tools available within the platform;
• manage and organise their content; and
• access features according to their selected subscription plan.

SandSpace provides the platform and tools only. Users are solely responsible for the content they create, upload, store, and manage using the Services.

6. Subscription Plans

SandSpace currently offers the following subscription plans:

• Free
• Bronze
• Gold

Each subscription includes different features, storage limits, usage allowances, and functionality.

Subscription features may change from time to time as the platform develops.

7. Payments

Where applicable:

• Subscription fees are payable in advance.
• Payments must be made using approved payment methods.
• Failure to pay may result in suspension or cancellation of your subscription.
• Subscription fees are non-refundable except where required by applicable South African law.

SandSpace reserves the right to change pricing. Any changes will not affect an active billing period and reasonable notice will be provided before revised pricing applies.

8. User Content

You retain ownership of all Content you create, upload, or store using SandSpace.

By using the Services, you grant SandSpace a limited, non-exclusive, worldwide licence to host, store, process, back up, transmit, and display your Content solely for the purpose of providing, maintaining, securing, and improving the Services.

You represent and warrant that:

• you own or have the necessary rights to your Content;
• your Content does not violate any law;
• your Content does not infringe the rights of any third party.

SandSpace does not claim ownership of your Content.

9. Acceptable Use

You agree not to:

• use SandSpace for any unlawful purpose;
• upload malicious software or harmful code;
• attempt to gain unauthorized access to any account or system;
• interfere with the operation or security of the platform;
• upload or distribute content that is unlawful, defamatory, fraudulent, threatening, abusive, or infringes the rights of others;
• misuse or abuse the Services.

We reserve the right to remove content or suspend accounts that violate these Terms.

10. Intellectual Property

All intellectual property relating to SandSpace, including but not limited to:

• software;
• source code;
• branding;
• logos;
• website design;
• graphics;
• user interface;
• documentation; and
• platform functionality,

is owned by or licensed to SandSpace and is protected by applicable intellectual property laws.

Nothing in these Terms transfers ownership of any SandSpace intellectual property to users.

11. Availability of Services

While we strive to maintain uninterrupted access to the Services, we do not guarantee continuous availability.

Services may be temporarily unavailable due to:

• maintenance;
• updates;
• technical failures;
• security incidents; or
• circumstances beyond our reasonable control.

12. Backups

Although SandSpace may maintain backups for operational purposes, users remain responsible for maintaining their own copies of important Content.

We recommend regularly exporting and backing up important information.

13. Privacy

Your personal information is processed in accordance with our Privacy Policy and applicable South African legislation, including the Protection of Personal Information Act, 2013 (POPIA).

14. Third-Party Services

SandSpace may make use of third-party providers for services such as payment processing, hosting, analytics, authentication, email delivery, or cloud infrastructure.

SandSpace is not responsible for the availability or practices of third-party services beyond our reasonable control.

15. Suspension and Termination

We may suspend or terminate your account where:

• you breach these Terms;
• you engage in fraudulent activity;
• your use threatens the security or operation of the platform;

16. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability arising out of or relating to these Terms or the Services shall not exceed the total amount paid by you to SandSpace during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

You agree to indemnify and hold harmless SandSpace, its owners, employees, contractors, affiliates, and service providers from any claims, liabilities, losses, damages, costs, or expenses arising out of:

• your use of the Services;

• your violation of any applicable law; or
• your infringement of the rights of any third party.

18. Electronic Communications

By using SandSpace, you consent to receive communications electronically, including notices relating to your account, subscriptions, updates, and legal notices.

Electronic communications satisfy any legal requirement that such communications be in writing.
